Terms of Service
These Terms of Service ("Terms") govern your use of the websites and services operated by TitanCart ("TitanCart," "we," "us," or "our"), including titancart.io, market.titancart.io, and help.titancart.io (collectively, the "Services"), and your purchase and use of TitanCart software products, extensions, and themes (the "Products"). By creating an account, making a purchase, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority where you live, and capable of entering a binding contract to use the Services. Certain features — including purchasing Products, downloading files, and receiving software updates — require an account. You agree to provide accurate account information, keep it up to date, and keep your login credentials confidential. You are responsible for all activity that occurs under your account.
2. Products and Purchases
TitanCart offers the following types of Products through market.titancart.io:
- TitanCart core plugin (Pro): sold as an annual subscription. Your subscription entitles you to software updates and support for the duration of the active subscription term.
- Premium extensions: sold as one-time purchases that include free lifetime updates for the purchased extension.
- Free products: certain Products (such as themes) may be offered at no charge but may require account registration to download.
Prices are shown at checkout and may change at any time; changes do not affect purchases already completed. We may modify, replace, or discontinue any Product, but doing so will not shorten an entitlement you have already paid for.
3. Payments
Payments are processed by Stripe, our third-party payment processor. We do not receive or store your full card number. By making a purchase you agree to Stripe's applicable terms and authorize the charge for your order, including recurring charges for subscription renewals as described below. You are responsible for any taxes that apply to your purchase.
4. Subscriptions and Renewal
The TitanCart core plugin subscription renews automatically at the end of each annual term, at the then-current renewal price, unless you cancel before the renewal date. You can cancel at any time from your account; cancellation takes effect at the end of the current paid term. When a subscription expires or is cancelled:
- Software you have already installed continues to function.
- Access to new software updates and support ends.
5. Refunds
Because our Products are digital goods delivered instantly, all sales are final once a Product has been downloaded. Downloading a Product starts your access to the software and waives refund eligibility. If you purchased a Product and have never downloaded it, you may request a full refund by contacting support@titancart.io. Whether a Product has been downloaded is determined by our delivery records. See our Refund Policy for details. Nothing in this section limits any non-waivable rights you may have under applicable law.
6. License Keys and Software Licensing
Purchases include a license key used to activate the Product, receive updates, and access support. License keys are issued per purchase and are for your use (or your client's use, where the purchase was made on their behalf). You may not sell, share, publish, or otherwise distribute license keys, and you may not use a key to obtain updates or support for sites beyond what your purchase allows. We may deactivate keys that are abused, shared, or obtained fraudulently.
The software license that applies to each Product's code is stated in the Product package. Your purchase primarily buys the services attached to the Product — delivery, license-key activation, updates, and support — and those services are governed by these Terms.
7. Acceptable Use
You agree not to:
- use the Services for any unlawful purpose or in violation of these Terms;
- interfere with, probe, or circumvent the security, license verification, or update-delivery systems of the Services;
- access the Services with automated tools in a way that burdens or disrupts them;
- misrepresent your identity or impersonate another person or entity;
- resell access to the Services or Products except as expressly permitted.
We may suspend or terminate accounts that violate these Terms.
8. Your Store and Your Data
The Products are self-hosted software that you install on your own website. You — not TitanCart — are responsible for your store's operation, content, legal compliance (including your own terms, privacy policy, and tax obligations), and the data of your customers. TitanCart does not host your store and does not have access to your store's database.
9. Intellectual Property
The Services — including the TitanCart name, logo, website content, and documentation — are owned by TitanCart or its licensors and are protected by applicable intellectual-property laws. Except for the software license stated in each Product package, no rights are granted to you other than the limited right to use the Services as described in these Terms.
10. Support
Support is provided for Products with an active entitlement (an active core subscription, or a purchased extension) via support@titancart.io and help.titancart.io. Support covers the Products as shipped; it does not include custom development, fixing third-party plugin or theme conflicts, or general website administration.
11. Disclaimer of Warranties
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES OR PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY HOSTING ENVIRONMENT, PLUGIN, OR THEME. YOU ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF YOUR SITE AND DATA.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TITANCART WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO TITANCART IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold TitanCart harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services or Products in violation of these Terms or applicable law, or from the operation of your own store.
14. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services if you materially breach these Terms. Sections that by their nature should survive termination (including Sections 5, 9, 11, 12, and 13) survive.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date above, and for material changes we will take reasonable steps to notify you (such as email or a notice on the Services). Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
